right

Did you know that the government has the right to take your property? Both the Federal and State constitutions allow the government to take an individual’s property when it is deemed to be in the interest of the public.  In Louisiana, the taking is referred to as an “Expropriation”. The most common takings are for projects like roadways, levees and public utilities.

If your property is about to be taken you need to understand what your rights are.  The same laws that give the State the right to take property also requires it to pay “Just Compensation” for what it takes. “Just Compensation” is the “Market Value” of the property taken plus any damages and expenses related to the taking. Determining “Just Compensation” can be very complex. Takings may be for the whole ownership, part of the property or just certain rights. Appraising for “Just Compensation” requires differing assumptions and rules depending on the type and purpose of the taking.

Over the years, A.R.E. Real Estate Services has provided “Just Compensation” appraisals for both the landowner and the taking authority. Our experience includes takings for roadways, levees, public utilities, access rights, flowage easements and air rights. We have been qualified as experts in real estate and real estate appraisal. Several of our appraisers have provided expert testimony in district courts across Louisiana. Our opinions have been cited by both the Court of Appeals and Supreme Court.
